Substantial defect in the goods, failure to use the goods for more than 30 days in each year of the warranty period, delay in the goods repair period
During the proceeding, it was found that the defects were due incorrect operation (specific driving). The court dismissed the claim because of absence of manufacturing defects at the time of action proceeding and fulfillment of the consumer’s alternative claims for elimination of defects of the goods.
