Subject of claim:
Importer is obliged to immediately remedy defect for free
Basis of claim:
Manufacturing defect of the goods.
On 26 June 2018 Leninsky District Court of Kemerovo satisfied the claim. The judgment was upheld by the appellate ruling dated 25 September 2018 of the Judicial Board for Civil Cases of the Kemerovo Regional Court.
The Supreme Court of the Russian Federation overturned the court ruling with reference to natural wear and tear, of which the consumer had been warned. The claims were further dismissed by the courts.
